Terms and Conditions – IGS Online Grocery Store

Welcome to IGS! These Terms and Conditions ("Terms") govern your use of the IGS website and the purchase of products from our online grocery store. By accessing or using our website, or by placing an order, you agree to be bound by these Terms. Please read them carefully.

1. Agreement to Terms

1.1. These Terms constitute a legally binding agreement between you ("you," "your," or "the Customer") and IGS ("we," "us," or "our"). 1.2. We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

2. Account Registration

2.1. To place orders through our website, you may need to register an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. 2.2. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. 2.3. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion. 2.4. You must be at least 18 years old to place an order or create an account with IGS

3. Product Information, Availability & Pricing

3.1. We strive to ensure that all details, descriptions, and prices of products appearing on our website are accurate. However, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. 3.2. All products are subject to availability. While we endeavour to ensure that all products displayed are in stock, we cannot guarantee availability. If an item you have ordered is unavailable, we contact you to offer a suitable substitute, automatically substitute with a similar item of equal or greater value, or issue a refund for the unavailable item]. 3.3. Prices are subject to change without notice. All prices are in Australian Dollars (AUD) and include GST where applicable.

4. Ordering & Payment

4.1. By placing an order, you are making an offer to purchase a product on and subject to these Terms. All orders are subject to availability and confirmation of the order price. 4.2. Once you place an order, you will receive an email acknowledging receipt of your order. This email is only an acknowledgment and does not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit/debit card or other accepted payment method. 4.3. We accept the following payment methods: 

Visa, MasterCard, American Express, PayPal, Apple Pay, Google Pay.

 4.4. Payment will be charged at the time of order placement, 

 4.5. Please note that a minimum order value of $200 applies to all orders free delivery

4.6 Frozen Goods Policy

To ensure the quality and safety of your frozen items, please take note of our specific policy regarding these products:

  • Delivery Presence is Key: When you're expecting frozen goods, we strongly recommend that you or someone is home to receive the delivery. If no one is available, your frozen items will be left unattended outside your nominated address. We cannot be responsible for the condition of goods left unattended, especially in varying weather conditions.
  • Delivery Estimates: For an estimated delivery date and time, please message our WhatsApp team. They'll be happy to provide you with more precise information to help you plan.
  • No Returns for Incorrect Orders (After Dispatch): Due to the sensitive nature of frozen products, we cannot accept returns or offer refunds for incorrectly ordered frozen goods once your order has been dispatched for delivery. Please double-check your cart carefully before confirming your purchase.
  • Quality Control: We maintain strict quality control for all frozen products. Your items are stored in our freezers right up until the moment they are dispatched for delivery and are kept at appropriate temperatures during transit to help preserve their frozen state.
  • Reporting Faulty Products: In the unlikely event you receive a faulty frozen product, you are eligible for a refund (provided the reason is acceptable, e.g., spoilage, severe damage). You must notify our team within 5 hours of delivery to qualify for a refund on these items. Please provide details and, if possible, photographic evidence when you contact us.

5. Website Use

5.1. You agree to use the website only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the website. 5.2. You must not misuse this website. You will not: commit or encourage a criminal offense; transmit or distribute a virus, trojan, worm, logic bomb, or any other material which is malicious, technologically harmful, in breach of confidence, or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through this website.

6. Intellectual Property

6.1. The content of the IGS website, including text, graphics, logos, images, and software, is the property of IGS or its content suppliers and is protected by Australian and international copyright laws. 6.2. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the website without express written permission from us.

7. Limitation of Liability

7.1. To the maximum extent permitted by law, IGS excludes all conditions, warranties, representations, or other terms which may apply to our site or any content on it, whether express or implied. 7.2. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: * use of, or inability to use, our site; or * use of or reliance on any content displayed on our site. 7.3. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it.

8. Indemnity

You agree to indemnify, defend, and hold harmless IGS, its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages, and/or costs (including, but not limited to, legal fees) arising from your use of this website or your breach of these Terms.

9. Governing Law & Jurisdiction

9.1. These Terms are governed by and construed in accordance with the laws of Victoria, Australia. 9.2. You agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia.

10. Severability

10.1. If any part of these Terms is found to be invalid, illegal, or unenforceable by any court of competent jurisdiction, that part will be severed from these Terms, and the remainder of the Terms will continue to be valid and enforceable.

11. Entire Agreement

11.1. These Terms, together with our Privacy Policy, constitute the entire agreement between you and IGS in relation to your use of our website and services, and supersede all prior or contemporaneous agreements, understandings, or representations.

12. Delivery & Tracking

We’re all about getting your goodies to you fresh, on time, and with a smile. Our delivery runs happen every Wednesday, Friday, and Sunday, covering Warragul (3820) and surrounding suburbs within a 20 km radius. To jump on the week’s delivery run, please place and finalise your order by Tuesday. Orders placed between Wednesday and the following Tuesday will be delivered on the next available delivery day.

We have a $50 minimum for delivery, and we’ll send you an email once your order is packed and ready to head your way. Want to check on your order? Just give us a call or message us – we’re happy to keep you updated.

Oh, and one last thing – you might notice your order arrives in a gently used cardboard box. That’s us doing our bit for the planet by reusing clean packaging whenever possible. Thanks for shopping small and local – you’re helping keep our community thriving.
